Terms of Service
This text was written in good faith to describe exactly how MAATICA works today. It has not yet been reviewed by a lawyer.
These terms apply to the businesses that use MAATICA ("you", "the business") and to the people who use it on their behalf. By using MAATICA you accept these terms and our Privacy Policy. A signed commercial agreement prevails over these terms where they differ.
1. The service
MAATICA is a multi-tenant inbox that brings a business's WhatsApp, Instagram, Facebook Messenger and website-widget conversations together, with an AI assistant (running on Amazon Bedrock) that can answer customers using the information the business provides. The business's team can monitor every conversation in real time, pause the assistant, take over, reply manually and summarize conversations.
2. Accounts and security
- Dashboard accounts are created for each business. You are responsible for the people you give access to and for keeping credentials secret.
- Multi-factor authentication is available (optional) and we recommend enabling it, especially for administrators.
- Tell us right away at nahuelramos.nr@gmail.com if you suspect unauthorized access.
3. Your responsibilities toward your customers
- You decide which conversations MAATICA handles and you are responsible, toward your customers, for having a valid legal basis and for telling them, in your own privacy notice, that you use a provider and AI to answer them.
- You must only message people in ways the platforms allow, for example respecting WhatsApp opt-in rules and the 24-hour messaging window, and using approved templates or the human-agent tag where required.
- The catalog, prices, stock and policies you load must be accurate. You are responsible for supervising the assistant's replies sent in your name.
- You handle your customers' requests about their data, and we help you (see the Data deletion page).
4. Acceptable use
You may not use MAATICA to send spam or unsolicited messages, to deceive or harass people, to sell prohibited products, to process sensitive data that the channel does not allow, to infringe others' rights, or to break the law or the policies of the connected platforms, including the WhatsApp Business Messaging Policy, Meta's Community Standards and Commerce Policies.
5. Meta integrations
- When you connect a Facebook Page, an Instagram professional account or a WhatsApp Business number, you authorize MAATICA to access it with the permissions shown in Meta's dialog, only to provide the service to you.
- Our use of Meta data follows the Meta Platform Terms and Developer Policies. You must also comply with Meta's terms for your accounts.
- You can disconnect a channel in Settings > Integrations, or remove MAATICA from your Facebook or Instagram settings, at any time. Disconnecting stops MAATICA from using that account. To delete the stored token and data, follow the Data deletion steps.
- Some features (WhatsApp Business app coexistence, Instagram insights, competitor and hashtag analysis, Meta Ads insights and Lead Ads) work only when you enable them and Meta grants the required permissions. MAATICA reads advertising data; it does not create, edit or pay for ads.
- Meta can change or limit its APIs and permissions. When that affects a channel we will tell you, but we are not responsible for Meta's decisions.
6. Other integrations
Tiendanube, Mercado Libre, Google Sheets and your website can be connected so the assistant knows your catalog and policies. These services are provided by third parties under their own terms, and they can change without notice.
7. AI-generated replies
The assistant generates replies automatically from your information and the conversation. AI can be wrong or incomplete. You can pause the assistant and reply as a person at any time, and you are responsible for the level of supervision you choose. We do not train AI models with your conversations.
8. Data processing
- You own your content and your customers' conversations. We process them only to provide the service and following your instructions, as described in the Privacy Policy, which lists our subprocessors.
- You can export your contacts at any time. When your account ends, we delete your data within 90 days unless the law requires us to keep it, and we can give you an export first if you ask.
9. Fees
Prices, plans and billing are set in your commercial agreement or order. Third-party costs are yours unless the agreement says otherwise.
WhatsApp. Meta bills WhatsApp messages separately, straight to your WhatsApp Business account, in Argentine pesos and on the card you add in Meta when you connect your number. The first 1,000 service messages each month per number are free; the rest, and templates, are charged at Meta's rates. MAATICA does not charge for those messages unless you agree otherwise with us. Instagram, Messenger and the web chat have no per-message cost.
10. Availability
We work to keep MAATICA available, but we do not guarantee uninterrupted or error-free operation. Service levels, if any, are set in the commercial agreement. We will tell you about known long interruptions.
11. Intellectual property
MAATICA's software, brand and technology belong to MAATICA or its licensors. You receive a right to use the service while your account is active, nothing more.
12. Suspension and termination
You can stop using MAATICA at any time by writing to us. We may suspend or close accounts that break these terms, normally after notice, or immediately when there is a security risk, a serious breach or a request from a platform or authority.
13. Limitation of liability
The service is provided "as is". To the extent the law allows, MAATICA is not liable for indirect or consequential damages, lost profits, or for replies the assistant sent in conversations that the business chose not to supervise. Nothing in these terms limits rights that consumer law grants and that cannot be waived.
14. Changes
We may update these terms when the service or the law changes. We will notify businesses of material changes by email before they take effect. The date at the top shows the current version.
15. Governing law
These terms are governed by the laws of the Argentine Republic. Disputes go to the ordinary courts of the City of Buenos Aires, unless a commercial agreement says otherwise.
